Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.193 of 2022 registered with MIDC Waluj Police Station, District Aurangabad for the offence punishable under Sections 302, 307, 325, 326, 323, 504, r/w 34 of the Indian Penal Code.

Earlier bail application of the applicant was not heard on merit. Therefore, the applicant approached this Court. The FIR is silent about the role attributed to the applicant. However, subsequently he has been shown played a role. In supplementary statement, it has been alleged that he hit the deceased with fist and blows and in a statement under Section 164 of Cr.P.C. of the complainant, he gave an axe in his hands. The injury report does not

960-ba-733-2024.odt (2) reflect the use of the alleged weapon. However, such injuries may be possible by spade. Nothing is recovered from the applicant. Considering the FIR and further investigation, no specific role appears to be attributed to the applicant. He is languishing in jail for sufficient time. The charge sheet has also been filed. For the above reasons, the Court is of the view that further detention of the applicant would serve no purpose. He deserve bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Sandeep Asaram Narwade, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses.
