This appeal is directed against the impugned Judgment and award passed in Motor Accident Claims Petition No. 262/2016 by the Member, Motor Accident Claims Tribunal, Dhule dated 21.01.2020. 2.

Heard Mr V.N. Upadhye, learned counsel for the appellant/Shriram General Insurance Company Ltd. He submitted that as per the interim stay granted by this Court, the appellant/insurance company has deposited Rs. 11,14,488/- in this Court. He further submitted that the original claimants have filed execution proceedings before the Motor Accident Claims Tribunal, Dhule. The matter has been amicably settled between the parties. He invited my attention to the copy of amicable settlement arrived between the parties before the National Lok Adalat at Dhule. On perusing the same, it is found that the dispute has been amicably settled between the appellant/insurance company and the original claimants at Rs.7,75,000/-. He submitted that the appeal needs to be disposed of in view of amicable settlement between the parties. He further submitted that the entire amount may be transferred to the Motor Accident Claims Tribunal, Dhule.

Having considered the submissions of Mr V.N. Upadhye, learned counsel for the appellant and in view of the amicable settlement arrived between the parties before the Panel of National Lok Adalat at Dhule, it is necessary to dispose of this appeal.

ORDER

(i) The appeal stands disposed of in terms of amicable settlement arrived between the parties on 11th December, 2021 before the National Lok Adalat at Dhule.

(ii) The Registry is directed to transfer the entire amount of compensation with accrued interest thereon to the Motor Accident Claims Tribunal, Dhule for making payment thereof to the original claimants within fifteen days from today.

(iii) In view of disposal of appeal, civil application also stands disposed of. ( SHRIKANT D. KULKARNI, J.) mta
