This is an application for granting regular bail under Section 439 of the Code of Criminal Procedure Code. Accused are arrested in Crime No. 411/2023 registered at Pundlik Nagar Police Station, Dist. Aurangabad for the offences punishable under Sections 302, 324, 323, 143, 148, 149, 109, 144 read with Section 34 of the Indian Penal Code and Section 135 of the Maharashtra Police Act.

It is averred in the report that the applicant in

(2) furtherance of their common intention they commit murder. A quarrel took place in front of house of applicant No.1. Ganesh succumbed the injuries sustained by knife. The investigation is over. The applicant No.1 Amruta is the student of M.Com and her examination is to be stated from 10-05-2024. The copy of hall ticket is filed on record and marked as 'X' for identification. 3.

Learned advocate for applicants therefore prays to grant the bail.

Considering the facts situation of the case, it would be proper to release applicant No.1 on certain condition on temporary bail for the purpose of examination. Considering the schedule of examination, temporary bail can be granted to the applicant No.1 till 10-06-2024. Hence, the following order:-

ORDER

a] Bail application is allowed to the extent of applicant No.1.

(3) b] Applicant No. 1 Amruta Kamlakar Dixit in connection with Crime No. 411/2023 registered at Pundlik Nagar Police Station, Dist. Aurangabad for the offences punishable under Sections 302, 324, 323, 143, 148, 149, 109, 144 read with Section 34 of the Indian Penal Code and Section 135 of the Maharashtra Police Act, be released on bail on furnishing personal bond of Rs.55,000/- [Rupees Fifty Five Thousand only] with one surety of the like amount on following conditions:- i) The applicant No.1 shall not tamper with the prosecution evidence and shall not pressurize the prosecution witnesses, in any manner.
