1] Heard learned counsel appearing for the parties. 2] The petitioner is working as a teacher in a school coming under the administration of Zilla Parishad, Nanded. The petitioner was suspended for mis-conduct. 3] In terms of statutory provisions, an appeal seems to have been already filed and according to the learned counsel for the petitioner, no decision is taken on the said appeal and according to the learned AGP,

WP 8073/17 - 2 - decision is already taken.

4] Since a statutory appeal is provided under the statute against the impugned order, we are of the opinion that the writ petition is premature one. If appeal is decided, the petitioner is at liberty to take further course of action in accordance with the procedure, otherwise the Chief Executive Officer, Zilla Parishad, Nanded, is directed to dispose of the appeal within two months from today.

5] The petition is disposed of accordingly. No costs.
