ORDER : - 1.

The present First Appeal is listed before us in today's Lokadalat.

The learned Counsel - Shri. Chapalgaonkar and learned Counsel - Shri. Rane for respondent No. 1 are present before us. 3.

The appellant has filed pursis for withdrawal of the appeal unconditinoally. The same is taken on record and marked as "X" for identification.

The learned Counsel for appellant - Insurance Company has no objection for withdrawal of the amount by the claimant. However, both the learned Counsel have made a request to transmit the amount lying with this Court to the learned MACT, Amalner, Dist. Jalgaon. The learned Counsel for the appellant would submit that the respondent nos. 2 and 3 are formal parties. 5.

In view of the above, the following order is passed.

ORDER

[i] The appeal is disposed of as withdrawn in terms of Pursis at "X".

[ii] The amount, whatsoever lying with this Court deposited by the appellant, be transmitted to the learned MACT, Amalner, for disbursement to the claimant, according to the law.

[iii] The Court Fee Refund Certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959. [iv] Pending Civil Application, if any, stands disposed of.
