When the present petition is taken up for hearing, it is informed that against the order dated 03.04.2019, the petitioner association has also preferred a representation to the Collector, Ahmednagar however, the same has not been yet considered by the Collector.

The learned counsel referring to the relevant rules and certain earlier decisions of this Court submitted that the petitioner association will not have any objection for keeping the CL-III, FL-II and FL-III shops closed during the period of three days in the constituency wherein, the elections are scheduled. However, since the dates for casting votes in both the Lok Sabha constituencies i.e. Ahmednagar and Shirdi are different, there is no rational in

964-WP-4775-2019.odt (2) the direction/order to keep the shops closed for the period of all six days in both the constituencies.

After having considered the submissions, it appears to me that the present petition can be disposed of by directing the learned Collector, Ahmednagar to hear and decide the representation submitted by the petitioner association on or before 20.04.2019. The petitioner association shall appear before the Collector on 18.04.2019 and if the arguments could not be heard on that day, the learned Collector shall give further date but decide the representation on or before 20.04.2019 keeping in view the relevant positions and the judicial pronouncements. 4.
