The learned Advocate for the Petitioner, on instructions, submits that considering the peculiar facts of the case, the Petitioner is in no way involved in the so called transaction of Accused No.2 as the Petitioner was only holding the General Power of Attorney and Accused No.2 has taken the entire proceeds of the first sale of the plot as well as the second sale of the same plot. He, therefore, submits on instructions that the Petitioner desires to withdraw this petition with a liberty to become a witness of the prosecution and assist the prosecution. Considering the above, this Criminal Writ Petition is disposed of as withdrawn.
*2* 2.cr.wp.580.16 Insofar as the prayer of the Petitioner that he should be treated as a witness for the prosecution is concerned, it is desirable to permit the Petitioner to make such a request, if so permitted in law, at an appropriate stage in the pending case.
