The petitioner prays for relaxation of the condition of completion of three years in jail for availing of the benefit of emergency parole under Rule 19(1)(C) of the Maharashtra Prisons (Mumbai Parole and Furlough) Rules, 1959.

The learned prosecutor brings to our notice that as on 30.04.2021, the petitioner/ convict has completed two years and nine months behind the bars. As such, as on date, he has completed 02 years, 10 months and 07 days.

In view of the above, this Criminal Writ Petition is disposed off.

We grant liberty to the petitioner to apply for emergency

*2* 17wp581o21 parole to the Jail Superintendent, Aurangabad Central Prison, after completion of three years imprisonment. As such, he would be eligible to move such an application in August, 2021. In the event, such an application is filed, the Jail Superintendent shall deal with the same in accordance with the law and the Maharashtra State circular dated 08.05.2020.
