The Court had passed a specific order on 11.01.2023 that failing to take steps to serve respondents No.1B and 1D within four weeks, the application would stand dismissed as against the unserved respondents. The opportunities were again granted to the applicant to serve the unserved respondents. The approach of the applicant appears not diligent. Hence, the application against respondents No.1B and 1D stands dismissed.

The second appeal of the appellant was dismissed on 18.01.1996 and after a delay of 5167 days this application for restoration has been filed. This application has not been filed promptly and unnecessarily kept pending. The entire conduct of the applicant appears that he had lost interest in the matter and even today nobody is representing him. Hence, the matter stands dismissed for default.
