The petitioner has preferred this petition challenging the action of the respondent No. 3 to postpone the meeting conveyed on 11.04.2019 for election of Chairman and Vice-Chairman of the petitioner-society, pursuant to order dated 11.04.2019 issued by the Ministry of Co-operation Marketing and Textile, State of Maharashtra. 4.

After the Court made it clear that the respondent No. 3 should not have postponed the meeting dated 11.04.2019 convened 1/2

939.odt to elect the Chairman and Vice-Chairman of the petitioner-society due to operation of model code of conduct and instructed the learned A.G.P. to take instructions from the respondent No. 2 as to when the meeting of Managing Committee of petitioner-society will be convene to hold the election to fill-up the vacancy. The learned A.G.P. on the basis of telephonic instructions received from respondent No. 2 make the statement that the election shall be conducted on and before 16.05.2019.

In view of the statement made by the learned A.G.P., the learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file fresh petition. 7.

Allowed to withdraw with liberty as prayed for. Petition is disposed of as withdrawn.
