1] Liberty is granted to amend the prayer clauses. 2] The learned counsel for the applicant submits that the Appellate Court held that the deceased was on bicycle and accused drove his vehicle in high speed and gave dash from the back side. The learned counsel for the applicant produced panchanama, which shows that the deceased had come under the rear wheels of the vehicle. The learned counsel for the applicant submits that considering the panchanama, the findings recorded by both the Courts below are perverse.

1424.25APPLN 3] In view of above, I pass the following order :

ORDER

i] Criminal Application is allowed.

ii] The substantive sentence imposed on the applicant in S.C.C.No.06/2012 by the Judicial Magistrate First Class, Mukhed on 12.02.2018, which is confirmed by Additional Sessions Judge-1, Nanded by judgment order dated 16.04.2025 in Criminal Appeal No.07/2018 stands suspended till the final hearing and disposal of Criminal Revision Application.

iii] The applicant be released on bail on the same terms and conditions imposed by the trial Court while granting bail. Bail before the trial Court.

iv] Criminal Application is disposed of accordingly. v] Criminal Revision Application is admitted.
