O R D E R

1.

This is an appeal preferred by the owner and driver of the vehicle involved in the accident. The counsel appearing for appellant No.2 driver has filed a pursis and the same is taken on record. In terms of the said pursis, appellant No.2-driver is no more interested in prosecuting the appeal. The matter is settled between the appellant No.1-owner, respondents-original claimants Nos. 1 to 5 and respondent No.6 insurer H.D.F.C. ERGO General Insurance Co. Ltd.

Mr. Pravin Igwe, Assistant Manager of H.D.F.C. ERGO General Insurance Co. Ltd., appellant No.1 Sanjay Pandu Badak, claimant No. 1 Chhaya, claimant No.4 Bandu and claimant No.5 Bhagabai are present in person. They are duly identified by their respective counsel. The parties admit the contents of the compromise and their signatures/thumb

fa1644.17 (27 -macp) -2impressions on it. Thus, the terms of compromise stands verified. The said compromise is taken on record and marked "X" for identification. 3.

A separate application has been filed to effect the compromise on behalf of the minor claimants and also learned counsel appearing for the claimants issued a certificate to the effect that the compromise is being effected taking into account the welfare of minor claimants. The said application seeking permission and certificate issued by the learned counsel are taken on record.

The award be drawn up in terms of the compromise placed on record, as aforesaid. In terms of the compromise arrived at between the parties, the first appeal is disposed of. Refund of court fees as per Rules. The parties to bear their own costs.
