ORDER :

1) Mr. T.M. Venjane, learned counsel for the petitioner submits that the advertisement wrongly mentions that the candidate should possess the certificate of 40 WPM in English typewriting and 30 WPM in Marathi typewriting certificate. As per the Government Resolution, the candidate should possess either English or Marathi typewriting certificate. It is not necessary to possess the certificate for English as well as Marathi typewriting. 2) The learned counsel submits that the petitioner has higher qualification. He is Bachelor of Engineering (Computer Science). According to the learned counsel, higher qualification cannot be a dis-qualification.

4) The advertisement has been issued in January, 2017. The entire selection process has progressed on the basis of advertisement. If the petitioner is aggrieved by the Clauses in the advertisement, the petitioner ought to have assailed the said advertisement before participating in the selection process. The selection process has almost been concluded. It is more than one and half year the advertisement has been issued. 5) Bachelor of Engineering (Computer Science) cannot be said to be a higher qualification qua English Typewriting of 40 WPM.
