PER COURT :

It is submitted that the Committee has refused to accept the proposal seeking validation of the tribe certificate on the ground that the validity certificate is not required for the course, the petitioner is prosecuting.

The Committee can not refuse to accept

the proposal if it is submitted in proper form and complying with all requirements. Even if individual submits the proposal, the Committee has to accept and decide the proposal on its own merits.

The Committee shall not refuse to accept the proposal of the petitioner on the ground on which the impugned communication is made. The Respondent No.4 shall not refuse to accept the examination form only on the ground that validity certificate is not yet submitted, if the petitioner is otherwise eligible. The Committee upon acceptance of the proposal shall decide the same expeditiously, preferably within six (6) months.

The Writ Petition is disposed of. No costs.
