PER COURT :- 1] The learned counsel appearing for the Respondent No.4, on written instructions, makes a statement that, the tribe claim of the respondent No.3 has been invalidated by the Respondent No.4. The Maharashtra Administrative Tribunal, while deciding the Original Application filed by the present petitioner, in para 14 made following observations:
As such, for the present the applicant has no cause to claim the relief mentioned above, however, we observe that, if ultimately the Committee decides the issue of caste validity certificate of Shri Yogesh Baviskar, then the applicant is entitled to file fresh original
5069.2014 WP.odt application before this Tribunal. With this liberty, original application will have to be dismissed. Hence, the order:
ORDER
The original application stands dismissed.
There shall be no order as to costs.
2] In the light of above observations, and the statement of the learned counsel appearing for the respondent No.4 that, the tribe claim of the respondent No.3 is invalidated, the petitioner can again approach to the Tribunal, by filing Original Application. In that view of the matter, the Petition is disposed of.
3] In case the petitioner files fresh Original Application before the Maharashtra Administrative Tribunal, the Maharashtra Administrative Tribunal to decide the same as expeditiously as possible, preferably within three months, from filing of such Original Application.
