The applicant seeks pre-arrest bail in connection with the Crime No. 0162 of 2021 dated 30/04/2021 registered with Jawahar Nagar Police Station, Aurangabad for the offences punishable under Sections 188, 273, 328 read with Section 34 of the Indian Penal Code and Section 59 of the Food Safety and Standards Act, 2006.

Although in the past the offences of similar in nature were registered against the applicant, he did not disclose it in these proceeding, when the matter was heard on 18-05-2021. As a result, ad-interim pre-arrest protection was granted. Even today, the applicant was heard saying that he was assisting his father in chemical business. Having said that, investigation shows the applicant had supplied prohibited articles (Guthka) to the arrested

Any how under Food Safety and Standards Act sale, distribution of prohibited food articles in the State of Maharashtra is prohibited in terms of notification dated 15-07-2000 issued under Section 30 of the Food Safety and Standard Act. Thus, in consideration of the facts of the case and in view of the order passed in the case of Vinod Gupta (Anticipatory Bail Application St. 2489 of 2000), I am not inclined to grant pre-arrest protection to the applicant. The application is rejected.
