1] The applicant - appellant has moved this application seeking condonation of 92 days delay in filing appeal against the impugned judgment and award passed by the Tribunal for the reasons set out in the application. 2] Heard learned counsel for the applicant. The respondents, though served, are absent.

3] Considering the submissions advanced in the light of the reasons assigned to condone the delay and having taken note of the fact that the pleadings of the

CA 5943/18 in FAST 13434/18 - 2 - applicant remain uncontroverted, I am of the view that a case is made out to condone the delay.

4] Accordingly, the application is allowed in terms of prayer clause (B) and disposed of. Delay is condoned. Appeal be registered and placed for admission on 21.8.2018.
