Learned Advocate for the petitioner submits that exparte stay has been granted by the respondent No.1 in appeal filed by respondent No.3. Though the petitioner had appeared, however, the appeal is not decided.

The learned AGP accepts notice for respondent No.1 and submits that, as the appeal is pending with respondent No.1, it would be decided on its own merits.

In case, the appeal is pending before respondent No.1 as claimed by the petitioner, then the respondent No.1 shall take decision on the appeal on its own merits in accordance with law

The writ petition is disposed of. No costs.
