Heard learned counsel for the Appellant. Seen the judgment delivered in Second Appeal No.250 of 2012 by this Court. By the decision dated 5th July, 2012 the appeal filed by the present Appellants in respect of eviction decree given against them is dismissed by this Court. Submissions made show that the possession is also handed over in the execution proceeding filed on the basis of eviction decree. Present appeal arises out of the judgment and decree in the suit filed for injunction by the appellants tenant. No injunction relief was given.

-:(2):- In view of the aforesaid circumstance, there are no merits in the appeal. Appeal is dismissed.

In view of final disposal of the second appeal itself nothing further survives in the civil application for stay and the same stands disposed of accordingly.
