Heard learned counsel for the applicant and the learned A.P.P. for the respondent/State. Perused the findings recorded by the Trial Court. 2.

Prima facie, it appears that the findings recorded by the Court below are in consonance with the evidence brought on record, in as much as the Trial Court relied upon the evidence of three eye witnesses coupled with the medical evidence.

crap2370.16 Therefore, no case is made out for grant of bail. The applicant was not on bail during trial. Hence, the Application stands rejected.

The Registry to send back the original record to the Registry of the Sessions Court, Nanded. Upon receipt of the original record, the concerned Registry to prepare the paper book and send it along with the original record to the Registry of this Court, as expeditiously as possible, however, within three months from today. 4.

After receipt of such paper book and record, liberty to mention for early hearing of the appeal.
