Heard learned counsel for the petitioner.

The case of the petitioner is that the tender floated by the respondent authorities, the petitioner was found to be leased one. However, the work order is not issued in favour of the petitioner. According to him, in view of the first position he is entitled for issuance of work order from the category of educated unemployee. After the record produced by the petitioner is perused, the authority had taken a decision to re-tender the work in question for the reasons disclosed in the communication, which is already part and parcel of the record.

The petitioner has not alleged any mala-fide against any of the officer who cancelled the tender in question. That being so, in our opinion, no case for interference in extra ordinary jurisdiction is made out. The writ petition fails and thus, dismissed. ( NITIN W. SAMBRE ) (PRASANNA B.
