Petitioner on the last date submitted before this court that he would produce the medical document indicating that the petitioner is suffering from Schizophrenia decease. Till date, no such document is produced.

The learned counsel for the petitioner submits that the court may decide the matter.

In the instant case, the maintenance granted is of an amount of Rs.7000/- per month to the respondent wife during the pendency of the divorce proceeding. The Judge of the family court has observed that although, the petitioner has claimed that he is a lunatic and suffering from mental illness but he has not been able

2 902 to demonstrate the same by producing any document / certificate from the government hospital and that there is no evidence that the petitioner has taken such a treatment. It is also observed that in 2010 he has purchased the land by sale deed dated 12.11.2010 for himself and not through the guardian. It is also noted that on 16.11.2021, the petitioner has sold the land to third persons and mutations were carried out and entries were made in 7/12 extract. It is noticed that the income of the petitioner would be such that he would be able to pay maintenance of Rs.20,000/- per month. It is also noticed that there is no evidence produced that the wife is serving although she is a BAMS qualified person and the court has granted maintenance of Rs.7,000/-.

Considering the above, no case is made out for interference.

The Writ Petition is accordingly dismissed.
