It is reported by the learned Advocate for respondent No.2 that pursuant to the impugned order, now charge-sheet came to be filed and the Trial has started. The petitioner even has filed application for discharge - Exh.109, which is rejected on 25.01.2019 and in view of this present writ petition with prayer to quash the proceeding of RCC No.183 of 2017 would not lie and the petition, thus, has become infructuous. In view of the same, after pointing out this, the learned Advocate for the petitioner seeks leave to withdraw this writ petition with liberty to challenge the order passed in discharge application dated 25.01.2019.

In view of above, the petition is disposed off with liberty to file appropriate proceeding available under law.
