Learned Counsel for the petitioner, during the course of arguments submitted, on instructions, that the petitioner is not pressing for relief in terms of prayer clauses 'A', 'C' and 'D', in the light of statutory appeal available under Section 7(I) of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952.

Learned Counsel for petitioner submits that, with regard to waiver of damages an application is preferred by the petitioner before the Central Board of Trustees i.e. respondent No.2. 3.

Respondent No.2 is directed to decide such application in accordance with the law. The petitioner is at liberty to pursue the same. 4.
