Heard learned counsel for respective parties. 2.

The petitioner assails the order dated 30.12.2021 passed by respondent no.1 - The Additional Chief Secretary @ Appellate Authority, Home (Transport) Department, Mantralaya Mumbai, whereby the order passed by respondent no.2 - R.T.O., Aurangabad was upheld.

Learned counsel for the petitioner contended that there were some taxes due on the vehicle. When an application for no use of the said vehicle was filed by the petitioner in the year 2014, no any order was passed on it. But subsequently in the year 2015, the vehicle was seized and it was auctioned. Admittedly, the petitioner had not challenged the auction of the said vehicle, which was conducted in the year 2015.

In view of the fact that the vehicle was already auctioned and it was directed to the petitioner to get back the amount after deducting the tax amount, I do not find any reason to interfere with the order dated 30.12.2021 passed by respondent no.1 - The Additional Chief Secretary @ Appellate Authority, Home (Transport) Department, Mantralaya Mumbai and order dated 22.01.2015 passed by respondent no.2 - R.T.O., Aurangabad under Article 227 of the Constitution of India.

Hence, Writ Petition stands dismissed. No order as to cost.
