1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant is apprehending arrest in connection with Crime No.83 of 2024, registered at Shirur-Anantpal Police Station, District Latur, for the offences punishable under Sections 420, 466, 468, 471 r/w 34 of IPC.
3] This court by order dated 03.05.2024 has granted interim protection to the applicant. In pursuance thereto, the applicant remained present before the police station and specimen signature has been taken for verification so also school stamp has been recovered. The case against the applicant is that one Ms. Mule has taken loan by fabricating the document. It is stated that the document which was given to the bank containing information from the employer which is signed by the applicant that Ms. Mule is the
2 931 employee of the school and that she is receiving salary and on that basis bank sanctioned the loan.
The learned counsel for the applicant submits that Ms. Mule has fabricated this document. It is further submitted that the applicant is not the beneficiary of the loan transaction and, as such, prima facie, no inference can be drawn that the applicant has manufactured this document.
4] Considering that this court has granted interim protection on 03.05.2024 and further investigation is proceeded in the matter and further custodial interrogation of the applicant is not required and, prima facie, the applicant is not receiving benefits from the loan transaction, the interim protection granted by order dated 03.05.2024 stands confirmed, on the following terms:
i] The applicant shall attend the police station as and when required by the Investigating Officer.
ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 5] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled.
3 931 6] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 7] The application stands disposed of.
