The learned counsel for the petitioners submits that the validation proceedings in respect of the tribe claims of the petitioners are pending with respondent No. 4. The employer has issued notice directing the petitioners to produce the same else services of the petitioners would not be continued.

We have also heard the learned Assistant Government Pleader for respondents.

To get the validation proceedings decided within the stipulated period is not in the hands of the litigants.

In the light of that, we pass the following order. 5.

The respondent No. 4 / committee shall decide the validation proceedings in respect of the tribe claims of the petitioners expeditiously and preferably within a period of nine (09) months from the date of appearance of the petitioners. The petitioners shall appear before the committee on 25.08.2020.

The impugned order is set aside. The respondents shall not take adverse action against the petitioners only on the ground that validation proceedings are pending.

The respondents may take further course of action against the petitioners depending upon the judgment that would be delivered by the scrutiny committee in the validation proceedings. Writ petitions accordingly are disposed of. No costs. ( R. G. AVACHAT ) ( S. V. GANGAPURWALA ) JUDGE JUDGE P.S.B.
