Heard learned counsel for the appellant.

The appellant-Acquiring Body has preferred this appeal challenging the judgment and award dated 25.04.1995 passed by the learned Civil Judge, Senior Division, Osmanabad, in L.A.R. No.231/1990. The acquisition pertains to the house property bearing House No. 139 situated at Karajgaon Tq. Omerga, to the extent of 35.30 square meter. The compensation awarded by the Special Land Acquisition Officer was Rs. 16853/-. The reference Court enhanced it to Rs. 17000/-. There is enhancement of Rs. 147/- only. For such a meager enhancement, present appeal is filed. The enhancement is extremely marginal. The present matter is squarely covered by the policy in respect of filing of the appeal in case of enhancement given by the reference Court less than four times. 3.

I do not find any substance in the appeal. The First Appeal is dismissed.
