The applicant/appellant has moved this application for condonation of delay of 101 days caused in filing appeal against impugned judgment and award for the reasons set out in detail in the application.

Heard learned counsel for the applicants. Learned counsel for respondents No. 1 to 3 are absent.

The learned counsel for applicant submits that the delay caused in filing the appeal was due to securing requisite clearance from the Head Office of the Insurance company situated at Jaipur. He submits that the applicants have good case to succeed in the appeal. In case delay is not condoned, there is every likelihood that a meritorious matter may be dismissed on technical reasons. 4.

Considering the submissions advance in the light of unchallenged pleadings, and the consequences to follow if delay is not condoned, I am of the view that delay deserves to be condoned. Accordingly, the application is allowed. Delay is condoned. Appeal be registered. Application stands disposed of.
