Heard the learned counsel for the applicant and the learned A.P.P. for the respondents/State.

The applicant is seeking bail in Crime no. 0143 registered with Sonai Police Station, District Ahmednagar for the offences punishable under Sections 3,7, 257 of the Indian Arms Act 19579.

The maximum punishment for the offence is three years. Nothing is to be recovered from the applicant. There were antecedents to his discredit, but considering the maximum punishment, it would be unjustifable to keep him behind bar. Hence, he deserves bail on certain conditions. Hence, the following

ORDER

(i) The application is allowed.

(ii) Applicant Bhaiyya Alias Kayyamuddin Kutubuddin Shaikh be released on bail on furnishing P. B. and S.B. of Rs. 570,000/- with one solvent surety of the like amount, in aforementioned crime registered with aforementioned police station, on the following conditions :- (a) He shall not tamper with the prosecution witnesses. (b) He shall attend the concerned police station as and when called by the Investigating Ofcer on written notice, till fling the charge sheet.
