At the outset, learned counsel appearing for respondent no.2 - Corporation raised a preliminary objection and submitted that, against the impugned Resolution No.98 dated 26.11.2018 passed by the Standing Committee of respondent no.2, substantive alternate statutory remedy to prefer an appeal as contemplated under Section 451 of the Maharashtra Municipal Corporation Act, is available to the petitioner and without availing the said remedy, petitioner has directly approached this Court.

In view thereof, learned counsel for the petitioner seeks leave to withdraw present petition with liberty to approach the Appellate Authority as contemplated under Section 451 of the Maharashtra Municipal Corporation Act.
