VERSUS
STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Applicant : Mr. Narvade Patil Ravindra B. AGP for Respondent/State : Mr. S.D. Kaldate Advocate for Respondent no.5 : Mr. Deshpande Sanjeev B. ...
CORAM : S.S. SHINDE & P.R. BORA, JJ.
Dated: January 28, 2016 ...
PER COURT :- Heard the learned counsel appearing for the applicant and the learned counsel appearing for respective respondents.
2.
The learned A.G.P. appearing for the Respondent/State vehemently opposed the prayer in the application. However, the amount of Rs. 1,48,369/- is deposited by Respondent Nos. 3 and 4 in compliance of the order passed by this Court in Writ Petition No.7887/2011 (Vasant Sahebrao Warangule V/s The State of Maharashtra & ors) decided on 10th September, 2012 and also the review application seeking review of the said order is also rejected, we have no hesitation to allow the Civil Application. The applicant is permitted to withdraw the amount of
5117.15ca Rs. 1,48,369/- (Rs. One Lac, Forty Eight Thousand, Three Hundred and Sixty Nine Only).
3.
It appears that, though the aforementioned amount is deposited in compliance of the order passed by the Division Bench of this Court in the aforementioned Writ Petition No. 7887/2011, the part of the order i.e. the petitioner shall be extended benefit of Career Advancement Scheme from 1st January, 1996 and shall be extended all monetary benefits expeditiously, is remained to be complied with. In that view of the matter, the Contempt Petition No. 535/2014 is restored to its original file. 4.
The Civil Application is allowed to the above extent and same stands disposed of.
5.
At the request of the learned A.G.P., list the Contempt Petition on 15th March, 2015.
