This is an application for pre-arrest bail in Crime No.I-94 of 2016 registered at Tophkhana Police Station, District Ahmednagar for the offences punishable under Sections 395, 452, 504, 506 and 354 of the Indian Penal Code and Section 4 read with 25 of the Arms Act. Heard the learned counsel for parties. Perused papers of investigation.

First informant is Pallavi Yogesh Thube resident of Sales Tax Colony, Shantiniketan, Ahmednagar. She alleged in her report that on 18th April, 2016 at around 01:45 p.m. Applicant and others entered her house, threatened and molested her due to political rivalry

and Applicant took away Rs.950/- from the pocket of Yogesh Thube husband of Complainant.

During investigation statements of witnesses have been recorded. They are the close relatives of Complainant. In the background of political rivalry and documents placed on record by Applicant showing that he is an industrialist and running two industries, this Court is inclined to grant protection to him and proceed to pass the following order -

O R D E R

I.

Criminal Application No.2400 of 2016 is allowed. II.

In the event of arrest of Applicant in Crime No.I94 of 2016 registered at Tophkhana Police Station, District Ahmednagar for the offences punishable under Sections 395, 452, 504, 506 and 354 of the Indian Penal Code and Section 4 read with 25 of the Arms Act, he shall be released on bail on P.R. and S.B. of Rs.15,000/- (Rupees Fifteen Thousand Only) each.

Applicant shall not tamper with the prosecution evidence and shall make himself available as and when required for investigation / interrogation. IV.

Pending investigating Applicant shall not enter the jurisdiction of Tophkhana Police Station, District Ahmednagar.
