Learned Advocate Mr. U.P. Giri, appearing for the appellant - acquiring body is present. Mr. Giriraj Kishanrao Joshi, Executive Engineer, Latur Minor Irrigation, Latur, is also present. Learned Advocate Mr. A.N. Sabnis for respondent no.01 is also present.

Mr. A.M. Phule, learned Assistant Government Pleader is present on behalf of the respondent - State.

A statement is made, that group of matters i.e. First Appeal No. 341 of 2019 and others were disposed of by the Court on 30th January 2019, as withdrawn, in view of the policy adopted by State vide Government Resolution dated 03-11-2016 read with

( Order ) (2) F.A. No. 0922 of 2019 Corrigendum dated 23-02-2017 and 13-08-2018. Under the said circumstance, this matter was only remaining. They are intending to withdraw the same. 03.

Hence, leave is granted. The First Appeal as well as civil application are disposed of as withdrawn. The amount of compensation deposited by the appellant in the Court, in the aforesaid appeal, is allowed to be withdrawn by the applicants in Civil Application No.2946 of 2019, in the manner and proportion as prescribed in the impugned award, along with accrued interest.

The appellant is entitled to get refund of court-fees in accordance with rules.
