The applicants are seeking condonation of delay of 2160 and 2175 days respectively in setting aside abatement, bringing legal heirs on record due to death of sole claimant Bapurao Babarao Jadhav.

In both matters, sole claimant died and legal heirs are necessary parties. The delay is unintentional.

Civil applications are allowed in terms of prayer clauses "B" and "C".

Both parties shall be at liberty to carry out amendment. Civil Applications for Withdrawal 5.

Heard both sides.

The acquiring body has deposited amount of Rs.35,40,065/- in aggregate in both appeals. The original claimant is the common who is survived by the legal heirs who are claiming disbursement of the amount. The acquiring body has deposited only 75% of the amount with accrued interest. 7.

Civil applications are allowed partly permitting the applicants to receive the amount with accrued interest on furnishing undertaking.

Civil Applications for Delay 8.

Applicants seek to condone delay of 2654 days in preferring appeals.

The applications have not been contested by the respondents/claimants.

There are no malafides on the part of the acquiring body in preferring appeals belatedly. The delay stands condoned. 11.

Learned counsel Mr. Deshmukh waives service of notice for respondents/claimants.
