DATE : 21st August, 2021 P.C.:- This is an application under Section 439 of the Cr.P.C. for releasing the applicant on bail in connection with Crime No.743/2020 registered with Jamkhed Police Station, District Ahmednagar under Section 307, 504, 506 of the I.P.C.

Prosecution case in short is that on 12.11.2020 at 6.00 pm the applicant, who is the uncle of the informant came to the home of the informant in a drunken state. He molested the mother of the informant. When informant and his brother Vishal, the injured, confronted the applicant, the applicant fished out a knife and stabbed Vishal in the chest. On these allegations FIR came to be registered under the aforesaid sections.

Heard Shri Karpe learned counsel for the applicant and Shri Ghayal learned APP for the State.

Shri Karpe submitted that injured-Vishal has been discharged from the hospital. Learned APP also does not dispute this position. Chargesheet has been filed. There are no criminal antecedents against the applicant. Since injured has been discharged from the hospital and as there is no possibility of conversion of offence into a more serious one, I am inclined to release the applicant on bail. Hence the following order is passed:

ORDER

I) Application is allowed.

II) Applicant be released on PR bond of Rs.15,000/- with one solvent surety in the like amount, in connection with Crime No.743 of 2020 under Section 307, 504, 506 of the I.P.C. registered with Jamkhed Police Station, District Ahmednagar.
