Present application is for condonation of delay of 1427 days in setting aside abatement and bringing legal heirs of sole appellant Shankar Tatyaba Taware.

The second appeal is yet to be heard for admission. The cause of action survives against legal heirs of deceased applicant. It is desirable to condone the delay. The learned counsel for the applicant is ready to workout the matter for admission on the next date. 3.

The Application is allowed in terms of prayer clause 'B' and 'C'. The amendment is to be carried out forthwith.
