Heard learned counsel for the applicant and learned APP for the respondent/State.

Brother of the applicant is complainant. Applicant is 72 year old. Complainant would allege that on 31-03-2021, the applicant being a member of unlawful assembly in prosecution of common object held an assaulted on him by deadly weapons. He would allege Ashok (co-accused)was armed with axe and he dealt a blow on his head. He would also allege that the applicant and the co-accused were armed with sticks and they assaulted him, his wife and son. It is informed across the bar that soon after the incident accused Laxman (father of applicant and complainant) had died; whereas Maroti, Ashok and Dnyaneshwar were arrested.

In consideration of the facts of the case, age of the applicant and role attributed to the applicant, in my view the custodial interrogation of the applicant may not advance prosecution case. Application is, therefore, granted. Thus, the order;

ORDER

In the event of arrest in connection with the crime No. 0065/2020 registered with Tadkalas Police Station, Dist. Parbhani for the offences under Sections 307, 324, 143, 147, 148, 149, 504, 506 of the Indian Penal Code, the applicant shall be released on bail on executing bond in the sum of Rs. 25,000/- [Rupees Twenty Five Thousand] with one or more sureties in the like amount.
