Heard learned Advocates for the parties. This application is filed for condonation of delay of 3796 days i.e. more than 10 years in filing the first appeal.

The learned Advocate for the applicant strenuously submits that the judgment and award impugned in this appeal is also subject matter of challenge in an appeal filed by the acquiring body and the same is admitted and pending in this Court.

Considering the fact that the appeal is already filed by the acquiring body, this Court is inclined to condone the delay. Hence, the following order :-

ORDER

(i) The Civil Application is allowed.

(ii) The delay of 3796 days caused in filing the appeal stands condoned.

(iii) The first appeal be registered.
