Heard the learned Counsel for the appellant for some time. 2.

The learned Counsel for the appellant, on instructions, seeks leave to withdraw this appeal with liberty to the appellant to file an application for bail before the Special Court after receipt of the final opinion about the medical examination of the victim from the concerned Medical Officer. 3.

Leave granted.

Criminal Appeal is dismissed as withdrawn with liberty to the appellant to file an application for bail before the Special Court after receipt of the final opinion about the medical examination of the victim from the concerned Medical Officer. 5.

We hope and expect that within a reasonable period, the Medical Officer would submit his final opinion about the medical examination of the victim. In case if the said final opinion is not given by the Medical Officer within a period of four months from the date of this order, the appellant will be at liberty to file an application for bail before the Special Court.
