PER COURT :- 1) Heard the learned Counsel for respective parties. 2) We are not inclined to accept the prayer of the Petitioner that, the proposal submitted for granting permission to open a Senior College for the academic year 2011-12, may be considered by this Court, since the same still survives. However, alternate submission, made by the learned Counsel for the Petitioner that, he will file a fresh proposal with the University and if such proposal is filed, same should be directed to be considered on its own merits, deserves consideration. 3) In the circumstances, if the proposal is submitted by the Petitioner within two weeks from today, the Respondent/University will consider the same, as expeditiously as possible, and preferably within three weeks from submitting such proposal.

4) In case proposal is recommended by the University, same shall be forwarded to the State Government, and State Government shall consider and take a decision on the same, as expeditiously as possible, preferably before the commencement of next academic year. Further, we make it clear that, if as per the revised prospective plan, village Terkheda is not included therein, in that case, the directions given by us need not be acted upon.
