IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 946 WRIT PETITION NO. 8573 OF 2025 SHAIKH ABDUL RASHEED MOHD IBRAHIM

VERSUS

THE STATE OF MAHARASHTRA THROUGH THE SECRETARY AND OTHERS .....

Advocate for the Petitioner : Mr. Dharurkar Chaitanya V. AGP for Respondents: Mr. V.M.Jawale .....

CORAM : MANISH PITALE & Y.G. KHOBRAGADE, JJ.

DATE :

5th August, 2025 P.C. :- 1.

Heard learned counsel for the Petitioner.

2.

We find that the prayer made in the present petition cannot be entertained at the behest of the Petitioner.

3.

The Petitioner claims that the school in which his daughters are studying, being a girls school, must have the senior most lady teacher as the Headmistress in terms of the Maharashtra Employees of Private. Schools (Conditions of Service) Regulation Act, 1977 and the Rules framed thereunder.

( 2 ) 946 wp 8573.25 4.

We find that only an aggrieved person or teacher from the school would have locus to raise such an issue, in accordance with law. 5.

The learned counsel for the Petitioner then submits that he has approached various authorities making serious allegations against the present incumbent in the post of Principal, indicating that certain scandalous activities are being undertaken and this is brought to his notice by his daughters.

6.

If that be so the Petitioner is at liberty to move appropriate proceeding or criminal prosecution to be launched against the responsible persons.

7.

No case is made out for entertaining the present petition. Accordingly, the Writ Petition is dismissed.
