The challenge in the present petition is to the order passed by the learned State Consumer Dispute Redressal Commission Maharashtra Circuit Bench at Aurangabad in First Appeal No. 193 of 2012 dismissing the appeal in default by order dated 22nd February, 2013.

This Court has already doubted maintainability of this writ petition as the said commission is not subordinate Court of this High Court. Learned Counsel for petitioner could not satisfy as to how the petition is still maintainable. Though he is relying upon some orders passed by this Court wherein delay condonation application was Pooja Kale 1/2

25 WP 4038-2013 rejected by the State Commission and this Court condoned the delay however, no such ratio is pointed out where it is held that this Court has jurisdiction over the State Commission. In view of the same, this Court had not inclined to entertain the petition and the same stands dismissed.
