Versus

S. M. Upase and another .. Respondents Shri Sujeet D. Joshi, Advocate for the Petitioner. Shri B. V. Virdhe, A. G. P. for Respondent Nos. 1 and 2. CORAM : S. V. GANGAPURWALA AND K. L. WADANE, JJ.

DATE : 26TH AUGUST, 2016.

PER COURT :

.

We have heard Mr. Joshi, the learned counsel for the petitioner and the learned Assistant Government Pleader. The grievance is made that, as per order of this Court representation of the petitioner seeking pensionary benefits is not decided. 2.

The learned A. G. P. has placed on record copy of communication stating that, claim of the petitioner for pensionary benefit is already rejected in the year 2013. It appears that, this fact was not brought to the notice of the Court when the writ petition was disposed of on 08th July, 2015.

2 cp 307.16 3.

The petitioner is at liberty to assail the said order/action refusing pensionary benefits. The contempt petition as such is disposed of. No costs.
