Mr. Salgare, the learned counsel for the petitioner submits that the petition was filed with a prayer to direct the respondent No.5 to submit last five years confidential reports of the petitioner to respondent No.3. So also the respondent No.3 should consider the proposal of the petitioner for increase in the age of retirement and that respondent No.1 be directed to issue order of increasing the age of retirement. 2.

Mr. Chavan, the learned counsel for respondent Nos. 4 and 5 submits that the confidential reports of five years are submitted to respondent No.3 by the respondent No.5 in May 2015. 3.

This Court vide order dated 7.5.2015 had observed that it is open for

wp5244.15 -2respondent No.3 to consider the proposal of the petitioner forwarded by the University for increase in the age of retirement from 60 years to 62 years. Mr. Latange, the learned counsel for respondent No.3 submits that the proposal is forwarded to the Government i.e. respondent No.1 with negative recommendation.

Mr. Patil, the learned Additional Government Pleader submits that the Government would take decision on the proposal received alongwith recommendation as given by the performance review committee and take decision on its own merits.

In the light of the aforesaid aspects of the matter, the purpose of filing writ petition stands served.

The Government may take decision on the said proposal received from respondent No.3 in respect of the petitioner regarding extension of age as per the Rules, Law, Policy, on its own merits, expeditiously, preferably within a period of three months from today. 7.
