Heard the learned APP for the respondent-State. 2.

The learned Principal District and Sessions Judge, Dhule by this request letter dated 29.03.2022 prayed to transfer the Criminal Appeal No.72 of 2013 pending on the file of Additional Sessions Judge, Dhule (Court No.5) to the Court of Additional Sessions Judge, Shahada, District Nandurbar for disposal according to law for the reasons that when this appeal was preferred, the Nandurbar District was not judicially separated, however, from 31.10.2013, Nandurbar Judicial District was separated. But, the present appeal remained on the file of the learned Additional Sessions Judge, Dhule (Court

2 907-Cri.Appln.1606-22.odt No.5). In this changing situation, it would be appropriate to transfer this appeal to the Court of learned Additional Sessions Judge, Shahada, Judicial District Nandurbar. The submissions made by the learned Principal District and Sessions Judge, Dhule are in pursuance of the change in separation of the Nandurbar District. Police Station Dhadgaon has now been within the jurisdiction of Nandurbar District. The appeal is pending since before the territorial jurisdiction was changed. 3.

In this facts and circumstances, a request made by the learned Principal District Judge and Sessions Judge, Dhule is accpeted and a Criminal Appeal No.72 of 2013 pending on the file of Additional Sessions Judge, Dhule (Court No.5) is directed to transfer the said appeal to the Court of the learned Additional Sessions Judge, Shahada, Judicial District Nandurbar for disposal according to law.

After transfer of the said appeal, learned Additional Sessions Judge, Shahada, Judicial District Nandurbar shall issue fresh notices to the parties to the appeal.
