The application is filed by the State for granting leave to file appeal against the judgment and order of Sessions Case No. 20/2008, which was pending in the Court of learned Additional Sessions Judge, Omerga, District Osmanabad. The respondents are acquitted of the offences punishable under sections 306, 304-B r/w. 34 of IPC and 498-A r/w. 34 of IPC. 2.

The submissions made show that Criminal Appeal No. 278/2014 filed by the original complainant against the present respondents is admitted by this Court by order dated 15.7.2014.

In view of this circumstance, the application filed for granting leave to file appeal is allowed and leave is granted. 4.

Appeal is admitted. Notice after admission is waived by learned counsel Shri. Patne for respondents. If there is compliance of provisions of section 390 of Cr.P.C. in Criminal Appeal No. 278/2014, there is no need for separate compliance in the present matter. List both the appeals on 12.3.2018.
