The petitioner has been convicted for the offence under section 354 of the Indian Penal Code, and therefore, sentenced to suffer R.I. for one year and fine with default stipulation. His appeal against conviction is subjudice before the Court of Additional Sessions Judge, Beed.

The conviction is sought to be set aside with the consent of parties. Original informant/victim is present before us. She gives express consent to allow this Writ Petition by setting aside conviction of the petitioner. In view of the same, we allow this petition in terms of

655.2023WP -2prayer clauses "A" and "B". The Criminal appeal pending before the Court of learned Additional Sessions Judge, Beed. 3.

The petition stands disposed of subject to deposit Rs.25,000/- with this Court within two weeks. 4.

On deposit of amount, the Registry is directed to transmit 50% amount to the Library, Advocates' Association of Bombay High Court, Bench at Aurangabad. The Registry is also directed to transmit remaining 50% amount deposited to the office of the Government Pleader for E-Library, as early as possible.
