Heard learned counsel for appearing parties. Perused the application.

For the reasons stated in the application, there is no impediment to allow the application. Hence, application stands allowed in terms of prayer clause "B". Proceeding of the first appeal be restored to its original stage. The delay caused in filing the present application stands condoned. The order of dismissal of first appeal is hereby quashed and set aside. The applicant shall deposit printing charges within a period of three weeks on restoration of the appeal to its stage. Failure to which, present order shall stands vacated automatically without further reference to the Court.
