Heard the learned counsel for the applicant.

The applicant - wife is seeking transfer of HMP No.246 of 2019, pending before CJSD, Jalna to Family Court Dhule. According to the applicant she is not having any independent source of income and she has to maintain three children born out of this wedlock. At present, she has also fled two proceedings against the respondent at Dhule. One is for getting maintenance under Section 125 of Cr.P.C. and other other is under the provisions of Prevention of Women from Domestic Violence Act, 2005.

Thus, it seems that the respondent - husband will have to come to Dhule for attending the dates of these proceedings. It appears highly diffcult for her to look after her three children in case she has to attend the dates at Jalna. Moreover, the distance between Dhule and Jalna is more than 200 Kms and therefore, it would not be convenient for her to travel such distance without help. The respondent despite service did not care to appear before

2 987 MCA 223-22 this court. Therefore, considering all these aspects and specially the conduct of respondent - husband following order is passed.

ORDER

1) The application is hereby allowed.

2) The HMP No.246 of 2019, pending before CJSD, Jalna is hereby transferred to Family Court Dhule for disposal according to law.

3) The respondent is directed to appear before the Family Court, Dhule on or before 19/12/2022.

4) The application is accordingly disposed of.
